Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites located at heckler.com and shop.heckler.com, and all related services (collectively, the "Site"), operated by Hecktech, Inc., an Arizona corporation doing business as Heckler ("Heckler," "we," "us").

By accessing the Site or purchasing products, you agree to these Terms.

1. Scope and Customer Types

These Terms apply to all users, including:

  • Retail customers
  • Commercial end users
  • Resellers, integrators, and distributors
  • Specifiers and consultants

If you purchase products for business, resale, or installation, you are deemed a commercial customer.

2. Orders and Acceptance

All orders are offers to purchase. Heckler may accept, reject, or cancel any order for any reason.

Orders are not accepted until confirmed by Heckler.

Cancellation

  • Standard products may be canceled prior to shipment
  • Custom/configured products are non-cancelable once production begins

3. Pricing and Payment

Prices are subject to change until order acceptance. Errors may be corrected at any time.

Payments are processed via third-party providers, including Shopify Payments. You authorize charges upon purchase.

4. Taxes

Customer is responsible for all applicable taxes unless valid exemption documentation is provided.

5. Shipping and Risk of Loss

All shipments are FOB Origin.

Risk transfers when products are tendered to carrier.

Customer must:

  • Inspect upon delivery
  • Note visible damage immediately
  • Report concealed damage within 5 business days

Customer is responsible for freight claims.

6. Lead Times

Lead times are estimates only.

Heckler is not liable for project delays, labor costs, or scheduling impacts.

7. Returns

  • 30-day return window for standard products
  • 15% restocking fee
  • Products must be unused and in original packaging

Non-returnable

  • Custom/configured products
  • Installed or used products

8. Product Information

All specifications, drawings, renderings, and configurator outputs are informational only.

Customer must verify suitability and compatibility.

9. Installation

Customer is responsible for installation.

  • Over 40 lbs: professional installation required
  • 40 lbs or less: professional installation recommended

Heckler is not responsible for structural integrity, fasteners, or site conditions.

10. Warranty

Products may be covered by a separate Warranty Policy.

Warranty Durations and Categories

Structural Components (Steel, Primary Frames) - 5 Years

  • Covered for defects in materials and workmanship under normal commercial use.

Mechanical Components (Hinges, Adjustable Elements) - 2 Years

  • Covered for defects in materials and workmanship.
  • Not covered for normal wear, loosening, or performance changes over time.
  • Periodic adjustment and tightening may be required as part of normal use.

Finish (Powder Coat and Surface Treatments) - 1 Year

  • Covered for defects in application, such as peeling, flaking, or adhesion failure.
  • Not covered for scratches, chips, abrasion, cleaning damage, or UV-related aging/color shift.

Third-Party Components

  • Covered solely by the original manufacturer's warranty, such as LINAK and other supplied components.

Consumables / Wear Items

  • Not covered unless expressly stated, such as gas springs and similar components.

Environmental Limitations

  • Products are not warranted for use in environments with excessive moisture, humidity, corrosive conditions including salt air, or outdoor exposure unless expressly stated.
  • Degradation in such environments is not considered a defect.

Care and Maintenance

  • Customers must follow product-specific care and maintenance instructions.
  • Failure to follow recommended care may void warranty coverage.

General Exclusions

Warranty does not cover damage or failure resulting from:

  • improper installation
  • misuse or abuse
  • modification or unauthorized repair
  • use with incompatible products or devices
  • failure to follow instructions or documentation
  • normal wear and tear

Remedies

  • Heckler may repair, replace, or refund at its discretion.
  • Labor, removal, reinstallation, and related costs are not covered.

11. Resale Restrictions

Products may only be resold through authorized channels.

Unauthorized marketplace sales, such as Amazon or eBay, are prohibited.

Heckler may cancel orders or terminate accounts for violations.

12. Intellectual Property

All product designs, drawings, and content are protected.

No copying, reverse engineering, or competitive use is permitted.

13. Export Compliance

Customer must comply with export laws.

Heckler may cancel orders that pose compliance risk.

14. Limitation of Liability

Heckler is not liable for indirect or consequential damages.

Liability is limited to the amount paid for the specific order.

15. Dispute Resolution

Consumers: arbitration.

Businesses: courts in Maricopa County, Arizona.

Class actions waived.

16. Purchase Orders

Customer PO terms are rejected unless signed by Heckler.

17. Miscellaneous

Force Majeure

  • Heckler shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including without limitation acts of God, natural disasters, fire, flood, earthquakes, epidemics or pandemics, labor disputes, supplier delays, material shortages, transportation disruptions, governmental actions, or failures of utilities or networks.

  • Heckler may update these Terms at any time.
